Lawyer Blog: How To Deal With An Anti-Dad Judge

Question:

I believe
that the female judge in my case is being sexist against me.

My ex has
been to jail numerous times in the past several years, has two domestic
violence convictions, and is mentally unstable. Yet the judge insists the
children should remain in their mother’s care for what I can only assume is she
doesn’t want to make a ruling in favor of the father!

What can I
do about her being blatantly sexist?

First off, I
am sorry to hear about your frustrations with your local court. There are
several options you may want to consider when it appears that you have a
“pro-Mom judge.”

Where I
practice (Indiana), litigants to post-dissolution litigation involving
petitions to modify child
custody
or parenting time have the ability under applicable trial rules, to
move for a one-time change of venue to another judge within the same or
contiguous county at the time a person files a post-dissolution petition to
modify custody.

In effect,
filing such a motion for change of judge will generally allow for a new set of
eyes and ears, different from the Judge who made the initial custody
ruling. A new judge would then look at the petition, schedule a
modification hearing, and when the evidence is closed, determine if a substantial
and continuing change has occurred which would warrant a modification.

Unfortunately
(or fortunately) Judges are human, too, and having formerly clerked for a
family law judge, I can tell you that they not only remember their litigants,
but they also talk about their litigants with other judge colleagues. This
should always be kept in mind, even when your case is transferred to a new
judge.

Even with a
new set of eyes and ears hearing your case, it is vital, especially in child custody
litigation, to ensure your matter is handled by competent legal counsel,
specifically by an attorney who practices exclusively in domestic litigation.
