My wife and I have been separated for
the last 7 years. She is in NY and I’m in North Carolina with non-court ordered
custody of our 4 kids. I’m ready to get a divorce and I’m trying to figure is
the SELF divorce kit good enough or do I need to hire a lawyer?

Answer:

Representing you using a self-help kit
in a divorce case is potentially dangerous. Even a skilled matrimonial attorney
would have difficulty representing himself in such a case because it is
difficult to maintain objectivity in one’s own case. As I believe Abraham
Lincoln once said, "An attorney who represents himself has a fool for a
client."

The more complicated the situation is,
the more likely you are going to have trouble doing it without a lawyer and the
more likely your wife will be able to take strategic advantage if she has legal
counsel.

You have children, which always makes
matters more challenging in any divorce proceeding. Even if you feel you can work
things out amicably with your wife, counsel from a competent attorney could
provide you a safety net if you are mistaken. Of primary and immediate concern
to you may be the need to consult with counsel concerning whether to quickly
obtain a court order securing your current custodial and residential
arrangement with your children to help ensure that your wife does not remove
them from your care.

I cannot stress the importance of
having a competent family law attorney represent you in this matter, and would
strongly advise you to consult with one.
