Re-Marrying Spouse and Health Insurance

Question:

I understand my obligation to child support. I was recently
notified that my Child Support is going to increase because of my children’s
increase in their Medial and Dental Insurance plans. My new deductions will be
$313.00. So here is my question:
My ex-wife is re-married and her new husband who is in the military and has
full health benefits and no kids. Can my kids qualify for his health insurance
coverage? I know it’s a long shot, but I wanted to ask…

Answer:

One or both parents can be required to pay for their
children’s medical insurance premiums as well as any expenses uncovered by the
insurance. The coverage of military insurance benefits is generally very good
and results in very little in the way of uncovered expenses. You should consult
with a skilled family law attorney who has experience with clients serving
in the military. Your wage statements and other income and expense information,
and those of the mother, must be carefully analyzed to ensure you are not
overpaying either child support or health insurance expenses. A highly skilled
and competent attorney should know how to petition the court seeking an order
modifying your support and insurance obligations to an amount, which takes into
account your economic circumstances. Your suggestion that the payment
arrangement with a lawyer "who would take the case and only collect if the case
is won" would be considered a contingency fee agreement. Most jurisdictions prohibit
such fee arrangements in domestic relations cases.
