Relocation and Child Custody

Question: I am
currently living in Baton Rouge, LA and I want to move to Marietta, GA with my
mother and stepfather. My question is if my daughter’s mother and I were never
married and my daughter has my last name: Who has sole or physical custody? And
if no one does, then can I move to GA without court established custody in LA?
The move would also be beneficial to the child because the job I would be
taking in GA would have full medical and dental for me and my daughter and I
would be taking a pay increase from what I gross now.

Answer: I generally do not suggest to my clients to remove a child from
the state she lives in without prior approval from the courts, except in very
necessary and appropriate circumstances. In your situation, it is critical to
determine whether any prior court orders have been entered, specifically but
not limited to paternity and custody of the child. If court orders have been
entered, then relevant statutory authority must be reviewed to determine
whether removal of the child from the state would be allowable to you and protective
of the child’s best interests.

Before doing anything, you should contact an
experienced and highly skilled family law attorney as soon as possible. Removal
cases are often challenging and complex. This case requires handcrafting and
strategic planning from a professional capable of handling complex family law
cases.

Before meeting with your attorney, make sure
that you gather all relevant documents and information concerning this matter
such as court orders, birth certificates, anything that you signed relating to
your daughter, DNA tests, and whatever else that will give your attorney a
comprehensive understanding of the situation.
