SingleDad : Divorce Evidence
GPS,
Keylogger Software and What can be used
I believe my
wife has installed keylogger software on my computer and she is using GPS or
some other tracking device to keep tabs on me to possibly use as evidence.
Is this
legal or is there a privacy invasion claim that can be used to my advantage?
Answer:
From Texas Divorce Lawyer Carrie H.
Westbrook:
Many states
laws were drafted before the time that cell phones were in every pocket and
tracking devises were portable. Judges often have to interpret laws to
encompass new technologies.
In many
areas, cases involving new technology such as cell phones and GPS tracking are
groundbreaking and unprecedented.
Many states
have made tracking or spying on a person, without their consent, illegal. In
Michigan, where I practice, it is illegal to eavesdrop, install a tracking
device on a car if you are the one doing the installation, or use information
that was illegally obtained.
The remedy
in a situation like this is usually found with your local prosecutor’s office.
If you believe that you are being illegally tracked or spied upon you should
contact the police or prosecutor in your area to begin an investigation.
