Question:

I married a woman with a daughter
about 9 years ago and am now divorced from her. During our time together we had
a son together, I have joint custody, a 50/50 split of my son but because my ex
would never truly let me pursue adopting her daughter I have currently have no
visitation rights on paper. I do, however, get her every time I get my son. Her
biological father is still in the picture but only gets her a total of about 10
hours a week split between two days; he is far from being an involved parent
due to personal and financial issues. He consults with me about pick-up times
and anything else that has to do with her. My question is there anyway I can
get something on paper that would give me visitation rights to my daughter? She
was 18 months old when I meet her and is now 10 almost 11.

Answer form Jeffrey Leving:

I applaud your actions to protect this
critical bond with your stepdaughter, and sympathize with the frustration you
must certainly feel over the current dilemma. Fortunately, so do many
others in this country. Non-parent individuals such as yourself have
bonded with their step children in very positive relationships. The legal
system needs to evolve and keep pace with the realities of our changing
society.

To achieve your goal it will be critical for
you to locate a highly skilled attorney who concentrates their practice
exclusively on matters of family law, and has successfully represented
non-parents in recent cases. One such attorney I recommend is Art Kallow
at 312-356-DADS
who recently obtained sole custody for a non-parent. Visit www.dadsrights.com for more information.
