Question or Comment:

I am a Single Dad living in Los Angeles, California. I want to know how to establish full custody
of my child. My son has been with me full time since he was 2 and he is 5 now. My son’s mother wants to take him for a week
now instead of every other weekend and I am concerned. It’s hard for me to say
yes and hand my son over when I have worked so hard and made so many sacrifices
in order for my child to have the best home life and stability. Without a formal custody agreement, I am
worried about my custody rights with my son. What should I do?

Answer from Jeffery Leving:

First and foremost, if you have not already had a court grant you custody of
your child
, you may need to file a custody petition immediately! You can go to court to file this petition but
I would strongly advise you to immediately retain competent counsel to guide
you to avoid the pitfalls in the system. Protecting your relationship with your
child and your rights seem critical now.

Without a court order granting you custody, there may be little that can be
done to prevent your child’s mother from unilaterally changing your visitation
time or removing your son from your care. To seek to ensure she doesn’t disrupt
and damage the father-child relationship that you have formed with your child
