Enforcing Custody Schedule

My name is David from Riverside, California. I am a 38-year
old divorced dad for over a year. Here is my situation: My ex wife is refusing
to let me see our 5- year old daughter. By divorce decree, I am suppose to see
her every other weekend and she will not allow me to see her at all. I have a
70/ 30-custody schedule. What are
my legal options to enforce my custody schedule?

From the facts given, it appears that your custodial times
in the divorce papers are not specific. If your custodial times in the divorce
papers are specific, then document your Ex-Wife’s refusal to let you see your
daughter.

Take the following actions:

  • Bring a friend with you when you go to pick up
    your daughter during your next custodial time.
  • Write a letter to your Ex-Wife documenting the
    frustration of visitation.

After two or three refusals, retain an attorney to file
contempt charges against your Ex-Wife. A licensed family law attorney will know
the next steps to take and you have done your part on documentation.

When you file Contempt charges, you are asking the court to
sanction your Ex-Wife for frustrating you visitation. This step is important
because it will send a message. I strongly recommend for you to take these
steps for the sake of time and the results you will gain in return.
